TERMS & CONDITIONS
Welcome to Franco Racquet Sports (FRS) These terms and conditions outline the rules and regulations for participation in our tennis and pickleball programs. By registering for any FRS class, camp, or private lesson, you agree to abide by these terms in full. FRS reserves the right to modify these terms at any time.
1. LIABILITY WAIVER, ASSUMPTION OF RISK, & MEDICAL CONSENT
Assumption of Risk: By participating in any Franco Racquet Sports (FRS) program, you acknowledge that tennis, pickleball, and related athletic activities involve physical exertion and an inherent risk of bodily injury. You agree to assume all risks associated with participation.
Release of Liability: You hereby release, discharge, and hold harmless Franco Racquet Sports, its owners, employees, coaches, and volunteers from any and all liability, claims, or causes of action arising out of any injury, damage, or loss sustained during participation. Because FRS operates at third-party partner locations and public facilities (including but not limited to HOA courts and city parks), FRS is not liable for injuries resulting from premises defects, court conditions, or open-air environmental hazards.
Primary Health Insurance Requirement: You certify that the participant is covered by a primary, valid personal health insurance plan. In the event of an injury, you acknowledge that your personal health insurance will act as the primary coverage for all medical expenses. Any accident policies maintained by FRS are strictly "excess" or secondary coverage.
Concussion & Medical Protocol: In the event of a suspected head injury or collision, FRS coaches have the unilateral authority to immediately remove a participant from play. Per FRS safety protocols, any player removed for a suspected concussion may not return to play for a minimum of 24 hours and must provide written clearance from a licensed physician before resuming activities. In the event of any medical emergency, you authorize FRS staff to secure emergency medical treatment or transportation, and you assume full financial responsibility for any such medical expenses.
Parental Consent: If the participant is a minor under the age of 18, the individual agreeing to these terms certifies that they are the parent or legal guardian of the participant, and agrees to this waiver and all financial obligations on the minor's behalf.
2. SAFE PLAY & CHILD PROTECTION Franco Racquet Sports strictly adheres to USTA Safe Play Standards. All FRS staff and coaches undergo comprehensive background screening and SafeSport training prior to employment. To ensure the safety of all minor participants, FRS enforces a strict open-air visibility policy. Coaches are never permitted to be in enclosed spaces alone with participants. All private and group instruction takes place strictly on public, open-air courts in clear view of the community. For private lessons involving minors under the age of 18, a parent, legal guardian, or designated adult must remain on-site and within clear line of sight of the court for the entire duration of the lesson.
3. MEDIA RELEASE By participating in our programs, you grant Franco Racquet Sports the right to take photographs and videos of players during classes and events. You authorize FRS to use these images for promotional, marketing, and social media purposes without compensation.
4. CODE OF CONDUCT Participants and parents are expected to behave respectfully toward coaches, staff, and fellow players. FRS reserves the right to remove any participant from the program for disruptive, abusive, or unsportsmanlike behavior without a refund.
5. GROUP LESSONS
Commitment & Recurrent Enrollment: Group classes operate on a recurrent 4-to-6-week session model. Your enrollment is continuous to guarantee your spot. To discontinue re-enrollment, a mandatory two-week notice prior to the end of your current session is required. Without this notice, you will be charged for the first two weeks of the following session.
Refund Policy: Once a session has started, no refunds will be issued. The only exception is a medical emergency that prevents participation. In such cases, prompt notification to FRS along with a doctor's note is required within 7 days, and a prorated credit will be applied to your account.
Class Minimums: A minimum of 3 participants is required for a group class to run. If this requirement is not met, you will be notified 24 hours in advance and a full refund will be provided.
Processing Fees: Any approved refunds to a credit card will incur a 6.8% processing fee.
6. SUMMER & HOLIDAY CAMPS
Withdrawals: If you withdraw your camp registration more than one week before the camp begins, you will receive a refund minus a 6.8% processing fee. If you withdraw less than one week before the camp begins, no refunds will be provided.
Camp Minimums: A minimum of 4 participants is required. If the minimum is not met, you will be notified 24 hours prior to the start date and a full refund will be issued.
7. PRIVATE LESSONS & BILLING
Pricing and Charging: Before your first private class, you will need to pay an invoice for the total amount of the class. Thereafter, we will charge your credit card within 5 business days after your lesson. Please check your spam folder regularly for receipts. Our private lessons are recurring. Should you decide to stop taking private lessons altogether, we require a 7-day notice.
Cancellations: Cancellation of a private lesson must be made at least 24 hours prior to the scheduled lesson time directly to your assigned coach via text message. If you fail to provide 24 hours' notice, you will be charged 60% of the class fee. "No-shows" will be charged the full 100% amount of the lesson.
Tardiness: Tardiness to private lessons by the client will not be compensated with make-up time. If an FRS coach is late, a prorated lesson fee adjustment or make-up time will be offered.
8. WEATHER & CANCELLATIONS
FRS prioritizes player safety. We reserve the right to cancel classes due to rain, wet courts, extreme heat, severe wind, or freezing temperatures at the discretion of the coaching staff.
Notification: Decisions on weather cancellations will be made up to 2 hours before the lesson. Official notification of cancellation will be sent by your coach via text message 1 hour prior to the start of class.
Credits: If FRS cancels a class due to weather, a make-up class or an account credit will be provided. No monetary refunds are issued for weather-related cancellations.
9. COMMUNICATION & BILLING DISPUTES
Responsibility to Read Policies: By checking the agreement box at checkout, you acknowledge that it is your sole responsibility to read, understand, and abide by all FRS policies, specifically including the two-week notice requirement for recurrent billing cancellations and our "No Refund" policies.
Responsibility of Communication: You are responsible for maintaining a valid email address and phone number on file with FRS, and for regularly reviewing all FRS communications (including checking spam/junk folders for invoices and updates). Failure to read our policies or missing a communication from FRS does not exempt you from your financial obligations.
Chargeback Agreement: You agree that you will not initiate a credit card dispute or chargeback for any charges applied accurately under these Terms & Conditions. In the event of an unwarranted dispute or chargeback, FRS reserves the right to immediately suspend all services to the participant and seek recovery of the disputed funds, plus any associated bank penalty fees.
